FMCSA Task Force Calls for Ban on Truck Lease Purchase Programs

A new report by the Federal Motor Carrier Safety Administration’s (FMCSA) Truck Leasing Task Force (TLTF) calls for a ban on truck lease purchase programs. The report, finalized on January 16, 2025, says these programs harm truck drivers. It recommends Congress take action to stop them.

TLTF Findings: Harmful Impact of Lease Purchase Agreements

The TLTF is an eight-member board formed in 2023 by the FMCSA. Their job was to study how lease-purchase programs affect truck drivers and the industry. The task force found that these programs benefit motor carriers but hurt drivers. Many drivers face financial struggles and have little control over their work.

Most lease agreements last three to five years. However, few drivers finish the full term. Data shows that fewer than 1 in 100 drivers who enter these agreements actually own their trucks in the end. The report also notes that many drivers suffer financial and emotional hardship.

Major Problems with Lease Purchase Programs

The TLTF report highlights several major concerns with lease-purchase programs:

  • Lack of Control: Motor carriers decide the driver’s work, pay, and expenses. Drivers have little say in these matters.

  • High Turnover: Many drivers leave these programs in debt. The turnover rate is very high.

  • Misclassification: Drivers are often treated as independent contractors. This means they miss out on important benefits like health insurance and retirement plans.

  • Financial Pressure: Lease agreements force drivers into deep financial commitments. Many end up earning little or even owing money to carriers.

Recommendations for Action

The TLTF recommends that Congress ban lease-purchase agreements. The report describes these programs as “irredeemable tools of fraud and driver oppression.” It states they harm the trucking industry and the national transportation system.

If a ban does not happen, the TLTF suggests strict regulations to protect drivers. These include:

  • Clear contract details so drivers understand their responsibilities.

  • Independent reviews of lease agreements before signing.

  • Protections for drivers who report unfair treatment.

  • Stronger enforcement by federal agencies like the Department of Labor (DOL) and the Consumer Financial Protection Bureau (CFPB).

Support from Industry Groups

The Owner-Operator Independent Drivers Association (OOIDA) supports the TLTF’s findings. OOIDA President Todd Spencer said lease-purchase programs take advantage of drivers. “Many people are drawn to trucking under the belief that hard work guarantees success,” Spencer said. “But predatory lease-purchase agreements prey on that trust, leaving drivers financially and emotionally broken.”

Different Opinions from the Industry

Some industry groups argue that lease-purchase programs offer a way for drivers to own trucks. They say these programs help those who cannot afford to buy a truck on their own. They believe better oversight could make lease-purchase programs work.

However, the TLTF report found that success stories are rare. Most drivers face serious challenges and financial losses.

What Happens Next with Lease Purchase Programs

The report will now be reviewed by Congress and the U.S. Department of Transportation. They will discuss possible actions. If Congress follows the recommendations, new rules could change how lease purchase agreements work.
